A federal court is set to deliver judgment in a fresh lawsuit challenging the emergency powers exercised by President Bola Tinubu, the plaintiffs said Wednesday.
The suit, filed by a group of lawyers and civil society activists, questions the constitutionality of the president’s declaration of emergency measures in parts of the country, arguing that the action exceeds the powers granted to the executive under the constitution.
Court documents show the plaintiffs are asking the court to nullify the declaration and restrain the federal government from enforcing directives issued under it. They contend that the emergency action was taken without meeting constitutional requirements, including legislative approval.
Government lawyers have urged the court to dismiss the case, maintaining that the president acted within his powers to protect lives and property amid security concerns.
The court adjourned the matter after hearing arguments from both sides and said a date had been fixed for judgment.
Nigeria has experienced recurring legal challenges over the scope of presidential emergency powers, particularly during periods of heightened insecurity in the country.
